1. Introduction
This Privacy Policy explains how SWFL Auto Exchange ("SWFL Auto Exchange," "we," "us," or "our") collects, uses, and shares information when you visit swflautoexchange.com (the "Site") or submit information through our vehicle lead form. SWFL Auto Exchange is a local, family-owned business that buys used vehicles directly from private sellers. This Policy describes our information practices; please read it so you understand how we handle your information.
2. Information We Collect
We collect the information you voluntarily provide through our lead form so that we can evaluate your vehicle and contact you about a potential offer. This includes:
- Full name
- Phone number
- ZIP code / vehicle location
- Vehicle Identification Number (VIN)
- Optional vehicle details, such as year, make, model, and mileage
- Whether the vehicle is paid off (paid off, still financed, or unsure)
- Notes you choose to add, including any competing offer you would like us to consider
- Photos of the vehicle that you choose to upload
How photos are stored. The vehicle photos you upload are stored with a third-party cloud storage provider and are made available to our team through a web link so we can review them (see Section 10). Because these links are not password-protected, please avoid including sensitive documents such as IDs, titles, or license plates in your photos.
Information collected automatically. When you visit the Site, our hosting provider automatically records standard technical data such as your IP address, browser type and user agent, referring page, and the date and time of your request in server logs, which are used to operate, secure, and troubleshoot the Site. Our pages also load web fonts from Google Fonts; when they do, Google receives the standard request information (including your IP address) needed to deliver those font files.
We do not operate an account system, and we do not collect or process payments through the Site. We do not intentionally collect sensitive categories of personal information through the lead form. Please do not submit information you do not want us to have.
3. How We Use Your Information
We use the information you provide solely to operate our business and respond to you, specifically to:
- Contact you by phone, text message, or email about the vehicle you submitted;
- Evaluate your vehicle and prepare an estimate or a firm written offer;
- Decode your VIN to auto-fill and verify vehicle details;
- Coordinate pickup or transport, title transfer, lienholder payoff, and payment if you accept an offer; and
- Keep records of our communications and transactions and comply with applicable law.
4. VIN Lookup via NHTSA vPIC
When you enter a VIN, we send that VIN to the U.S. National Highway Traffic Safety Administration (NHTSA) Product Information Catalog and Vehicle Listing (vPIC) public API in order to automatically decode standard vehicle details such as year, make, and model. The VIN describes the vehicle and is not by itself tied to your name or contact details when sent to that service. Your use of NHTSA's public data service is subject to NHTSA's own terms and practices.
5. Cookies & Tracking Technologies
A cookie is a small text file that a website can store in your browser. We keep our use of cookies to a minimum:
- Preference storage — we use a small amount of local browser storage only to remember your cookie choice. It does not track you across other websites.
- Analytics (optional) — if you select "Accept" in our cookie banner, we load Google Analytics (GA4), a service provided by Google, to understand aggregate site traffic and how visitors use the Site. Google Analytics sets cookies and collects usage data such as your IP address, device and browser information, pages viewed, and referring pages, and processes it on our behalf; Google may also process this data as described in its own privacy policy. Analytics does not load if you select "Decline." We do not use advertising or cross-site tracking cookies.
When you first visit the Site you will see a cookie banner where you can Accept or Decline non-essential cookies. You can change your choice at any time using the "Cookie preferences" link in the footer. You can also block or delete cookies through your browser settings; if you do, some parts of the Site may not work as intended.
6. We Do Not Sell Your Personal Information
We do not sell your personal information, and we do not rent or trade it to third parties for their own marketing. We use the information you provide only to communicate with you and to evaluate and complete a potential purchase of your vehicle, as described in this Policy.
7. SMS, Call, and Contact Consent
When you submit the lead form, you tick a consent box agreeing to be contacted about your vehicle. By doing so, you consent to receive phone calls and text (SMS) messages from us at the phone number you provide, including for the purpose of discussing your vehicle and any offer. Message and data rates may apply, and message frequency varies. Your consent to be contacted is not a condition of any purchase. You may opt out of text messages at any time by replying STOP, and you may ask us to stop contacting you at any time by calling us or emailing offers@swflautoexchange.com.
8. Email Marketing and Newsletter
When you submit our lead form, you also agree that we may add you to the SWFL Auto Exchange business newsletter and send you periodic marketing emails, promotions, and updates about our services, using the contact details you provide. We may use a third-party email service provider to send and manage these messages. Your consent to receive the newsletter is separate from the vehicle-specific contact consent described in Section 7 and is not a condition of any sale. You may unsubscribe at any time by clicking the "unsubscribe" link in any newsletter email or by emailing offers@swflautoexchange.com; opting out of the newsletter will not stop us from contacting you about a vehicle you submitted.
9. Data Retention
We keep the information you submit for as long as reasonably necessary to respond to your inquiry, evaluate your vehicle, complete any resulting transaction, and satisfy our legitimate business, recordkeeping, tax, and legal obligations. When we no longer need your information, we will take reasonable steps to delete it or render it no longer identifiable. You may request deletion sooner as described below.
10. Third-Party Service Providers
We rely on a small number of third-party service providers to run the Site and process form submissions on our behalf. These include providers for website hosting, cloud file storage (used to store the vehicle photos you upload), email delivery (used to send your submission to our team), text-message (SMS) alerts to our own staff notifying them of a new submission, and a spreadsheet and automation service we use to keep internal records of submissions. These providers may process your information only to provide services to us and are expected to protect it. As noted above, we also transmit your VIN to the NHTSA vPIC public API to decode vehicle details. We may also disclose information where required by law, to enforce our agreements, or to protect the rights, property, or safety of our business, our customers, or others.
11. Security
We take reasonable administrative and technical measures intended to protect the information you submit against loss, misuse, and unauthorized access. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You submit information to us at your own discretion.
12. Children's Privacy
The Site and our services are directed to adults and are not intended for children. We do not knowingly collect personal information from anyone under the age of 18. If you believe a minor has provided us with personal information, please contact us and we will take reasonable steps to delete it.
13. Your Rights and How to Request Deletion
Depending on where you live, you may have rights regarding your personal information, such as the right to access, correct, or delete it, or to opt out of certain communications. To exercise any of these rights, or to ask us to delete the information you submitted, contact us by phone or email using the details below. We will respond within a reasonable time and may need to verify your identity before acting on your request.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. Changes are effective when posted. We encourage you to review this page periodically.
